1. Agreement to Terms

Welcome to DelivaHere! By using our platform, you agree to these Terms of Service. If you don't agree, please don't use our services.

DelivaHere connects merchants with customers for product delivery. We provide the platform, but merchants are responsible for their products and customer service.

2. Who Can Use DelivaHere

Customers: You must be at least 18 years old or have parental consent. You need a valid phone number and delivery address in Nigeria.

Merchants: You must be a registered business in Nigeria or an individual authorized to sell products. You're responsible for all product listings, pricing, and fulfillment.

3. How DelivaHere Works

For Customers:

  • Browse products from multiple merchants
  • Add items to your cart and place orders
  • Pay securely through our payment partners
  • Receive deliveries at your specified address
  • Use your wallet for faster checkout and refunds

For Merchants:

  • List products with descriptions, prices, and images
  • Manage inventory and product availability
  • Process orders and arrange deliveries
  • Receive payments through our platform
  • Communicate with customers about orders

4. Payments and Fees

Customer Payments:

  • We accept payments via Paystack, wallet balance, and saved cards
  • Prices include VAT (7.5% in Nigeria, unless otherwise stated)
  • Payment gateway fees may apply (capped at ₦1,000)
  • All prices are in Nigerian Naira (₦) unless stated otherwise

Merchant Payments:

  • We collect payments on your behalf
  • Platform fees and taxes are deducted before payout
  • Payouts are processed according to our payment schedule
  • You're responsible for VAT remittance if applicable

Wallet:

  • You can fund your wallet for faster checkout
  • Wallet funds don't expire but aren't insured deposits
  • Refunds are credited to your wallet automatically
  • Wallet withdrawals may take 3-5 business days

5. Delivery

Delivery Times: Merchants set estimated delivery times. While we strive for accuracy, delays can occur due to weather, traffic, or unforeseen circumstances.

Delivery Fees: Calculated based on distance and merchant location. Fees are shown before you complete your order.

Failed Deliveries: If delivery fails due to incorrect address or unavailability, additional fees may apply for re-delivery.

6. Returns and Refunds

Return Eligibility:

  • Products damaged during delivery
  • Wrong items delivered
  • Products significantly different from description
  • Defective or expired products

Refund Process:

  • Request refund within 7 days of delivery
  • Provide photos and description of the issue
  • Refunds credited to your wallet within 5-7 business days
  • Merchants may require product return before refund

Non-Refundable Items: Perishable goods, personalized items, and opened hygiene products may not be eligible for refund unless defective.

7. Merchant Responsibilities

As a merchant, you agree to:

  • Provide accurate product descriptions and pricing
  • Maintain product quality and safety standards
  • Fulfill orders promptly and professionally
  • Handle customer inquiries and complaints
  • Comply with Nigerian consumer protection laws
  • Maintain necessary business licenses and permits
  • Collect and remit applicable taxes (VAT, etc.)
  • Not sell prohibited or illegal items

8. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate delivery information
  • Be available to receive deliveries
  • Inspect products upon delivery
  • Report issues promptly (within 7 days)
  • Not abuse refund or return policies
  • Treat delivery personnel with respect

9. Prohibited Activities

You may not:

  • Sell or buy illegal, counterfeit, or stolen goods
  • Provide false information or impersonate others
  • Manipulate prices, reviews, or ratings
  • Interfere with platform operations or security features
  • Scrape, copy, or misuse platform content
  • Harass, threaten, or abuse other users
  • Use the platform for money laundering or fraud

10. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Receive multiple customer complaints
  • Fail to fulfill orders or provide refunds
  • Pose a security risk to our platform or users

You may close your account at any time. Pending orders and financial obligations must be settled before closure.

11. Intellectual Property

DelivaHere Content: Our logo, design, and platform features are our property. You may not copy or misuse them.

Your Content: You retain rights to your product listings, images, and descriptions. By posting, you grant us permission to display them on our platform.

Copyright Infringement: If you believe content violates your copyright, contact us immediately with proof of ownership.

12. Limitation of Liability

DelivaHere is a platform connecting merchants and customers. We are not responsible for:

  • Product quality, safety, or legality
  • Merchant fulfillment or customer service
  • Delivery delays or failures beyond our control
  • Disputes between merchants and customers
  • Loss of data, profits, or business opportunities
  • Unauthorized access to your account

Our total liability is limited to the fees you paid in the last 12 months, or ₦10,000, whichever is lower.

13. Dispute Resolution

Customer-Merchant Disputes: We encourage you to resolve disputes directly. If needed, contact our support team for mediation.

Legal Disputes: If we can't resolve a dispute informally, it will be settled through arbitration in Lagos, Nigeria, under Nigerian law.

14. Changes to Terms

We may update these terms from time to time. We'll notify you of major changes via email or platform notification. Continued use after changes means you accept the new terms.
